HOW WE HANDLE YOUR DATA AND RIGHTS

TOKAI ERFTCARBON GmbH (hereinafter “Tokai” or “we") is pleased that you are visiting our website. Data protection and data security when using our website are very important to us. We would therefore like to provide you with information at this point on which of your personal data we collect when you visit our website and for what purposes it is used. The Privacy Policy is continuously updated to the extent required. Using male and female linguistic forms is dispensed with for the sake of better readability. Any and all references to persons apply equally to all genders.

  • GENERAL INFORMATION ON DATA PROCESSING

    In principle, we process the personal data concerning you as a user only to the extent that this is necessary to provide a functioning website as well as our contents and services. Exceptions apply in cases where you have given us your consent for certain processing operations or where processing the data is permitted under statutory regulations.

  • DATA CAPTURING ON THE WEBSITE (LOG FILES)

    1. Description and Scope of Data Processing
    Every time our website is accessed, our system automatically captures data and information from the computer system of the accessing computer.
    This is usually the following information:
    - browser type and browser version
    - operating system used
    - referrer URL
    - time of server request
    - IP address
    This data is not merged with any other data sources.

    2. Purpose and Legal Basis of Data Processing
    Making the website available to your computer requires temporary retention of the IP address by the system. To do this, your IP address must remain retained for the duration of the session. It is retained in log files to ensure the functionality of the website. Moreover, the data serves us to ensure the security of our information technology systems. The legal basis for this processing is point (f) of Art. 6(1) GDPR.

    3. Duration of Retention
    The log files are retained for seven days and erased after the safekeeping period has expired, unless we can demonstrate a legitimate interest in any further safekeeping for the purpose of tracking irregularities.

  • E-MAIL CONTACT

    1. Description and Scope of Data Processing
    Where any contact is established using the e-mail address provided on our website, personal data is processed and is retained by us for the purpose of dealing with your concern.

    2. Purpose and Legal Basis of Data Processing
    This data is processed on the basis of point (b) of Art. 6(1) GDPR, where your request s related to the performance of a contract or is required in order to take steps prior to entering into a contract. In all other cases, the processing is based on your consent (point (a) of Art. 6(1) GDPR) and/or on our legitimate interests (point (f) of Art. 6(1) GDPR), since we have a legitimate interest in effectively dealing with the requests addressed to us.

    3. Duration of Retention
    The data is generally erased once it is no longer necessary for achieving the purpose of its collection. In addition, any data retained on the basis of a consent given by you is retained on this basis only until you withdraw your consent.
    To the extent that data is no longer required to fulfil any contractual or statutory duties, including safekeeping duties under commercial and tax law, as well as to pursue any legitimate interests, i.e. for the preservation of evidence within the scope of the statutory limitation regulations, this data is regularly erased.

    4. Right to Withdraw Consent (Article 7(3) GDPR)
    Information on how to exercise the right to withdraw the consent given by you is available under clause VI. 7.

  • DATA SUBJECT RIGHTS

    Where any personal data is processed, the respective data subject needs to be informed about the following rights:

    1. Right of Access (Art. 15 GDPR)
    You may obtain from the controller confirmation as to whether or not personal data concerning you is being processed.

    2. Right to Rectification (Art. 16 GDPR)
    You have a right to rectification and/or completion towards the controller where the processed personal data concerning you is inaccurate or incomplete. The controller has to rectify the data without delay.

    3. Right to Erasure (Art. 17 GDPR)
    You may obtain from the controller the erasure of personal data concerning you without undue delay and the controller has the obligation to erase this personal data without undue delay, unless one of the exceptions provided for in the GDPR applies or we are obliged to keep the data in question due to any other statutory duties of safekeeping.

    4. Right to Restriction of Processing (Art. 18 GDPR)
    You may obtain from the controller restriction of processing of the personal data concerning you under the conditions regulated in the GDPR.

    5. Right to Data Portability (Art. 20 GDPR)
    You have the right to receive the personal data concerning you, which you have provided to a controller and whose processing is based on a consent or on a contract with you, in a structured, commonly used and machine-readable format. In addition, you have the right, under the conditions regulated in the GDPR, to transfer this data to another controller without hindrance from the controller to which the personal data has been provided.
    In exercising this right, you also have the right to obtain that the personal data concerning you be transferred directly from one controller to another controller, where technically feasible. This may not adversely affect the rights and freedoms of others.

    6. Right to Object (Art. 21 GDPR)
    You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1), including profiling based on those provisions. Where the personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. Where you object, the personal data concerning you is no longer processed for such purposes.

    7. Right to Withdraw Consent (Article 7(3) GDPR)
    You have the right to withdraw at any time your consent given under data protection law. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. This also applies to any withdrawal of consents given to us before the GDPR has become applicable, i.e. prior to 25 May 2018. In this case, all personal data retained on the basis of the respective consent given is erased, unless any other legal basis for its continued retention exists under law. If you want to withdraw your consent, please use the contact data under clause I or II.

  • RIGHT TO LODGE COMPLAINT

    In case of any infringements of the regulations applicable under data protection law, the data subject have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedies.

  • DIRECT LINKING TO GOOGLE MAPS

    We have integrated a button (external link) to Google Maps on our website. Subject-matter, scope and the relating data processing are incumbent upon the operator of the map displaying service. Clicking the button allows you to the website of the map displaying service operator. Please note that we are not the provider (controller under Art. 4(7) GDPR) of the relating data processing, but services of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA94043, USA. Where you use this direct linking, your browser establishes a direct connection to the servers of Google, with data for the map function offered by Google being processed by Google itself during such use. For further information on the purpose and scope of the data capturing and its processing by Google, please refer to Google's Privacy Policy.
